HHS proposes year-long delay for 340B rule

US Health and Human Services is proposing to delay a rule that would set new drug ceiling prices in the 340B drug discount program. It would be the fifth time the rule has been postponed. It was supposed to start July 1. Comments are due on May 25. NCHA will provide analysis of the proposed delay soon. On Friday, oral arguments began in American Hospital Association v. Alex M. Azar II. The AHA, alongside 34 state and regional hospital associations, began testimony to prevent the Medicare payment cuts to many 340B hospitals under the Medicare Outpatient Prospective Payment System final rule.
