On June 25, 2018, the Centers for Medicare & Medicaid Services (CMS) published a Request for Information (RFI) regarding the physician self-referral law, more commonly known as the Stark law. CMS published the RFI to further its efforts to remove unnecessary obstacles to care coordination and accelerate the transformation to a value-based system of care. To support these efforts, NCHA joined the American Hospital Association in asking CMS to create a new innovative payment exception to the Stark law for value-based payment arrangements and to provide clear, unambiguous definitions of critical requirements of the Stark Law.
